1. Agreement
Welcome to AtlantaCalendar (“we,” “us,” or “the Service”), operated at theatlantacalendar.com. By accessing or using the Service — including browsing events, creating an account, submitting listings, purchasing boosts or sponsorships, or subscribing to email — you agree to these Terms of Service.
If you do not agree, do not use the Service. We may update these Terms; continued use after changes means you accept the revised Terms.
2. What AtlantaCalendar is
AtlantaCalendar is a metro Atlanta events discovery and listing platform. We publish curated and user-submitted event information and related editorial content. We are an information and advertising platform — not a ticket seller, venue, promoter, or event organizer unless we expressly say otherwise for a specific campaign.
3. Accounts
You may create a host account with email/password or Google sign-in. You are responsible for keeping your credentials secure and for activity under your account. Provide accurate information and keep it current. We may suspend or terminate accounts that violate these Terms or harm the community.
4. User-generated content & public sources
Event titles, descriptions, flyers, photos, videos, venues, times, prices, and related details may be submitted by third parties (hosts, venues, promoters) or aggregated from public web sources and partner materials. Content is provided “as-is” for informational purposes.
You retain ownership of content you submit, but you grant AtlantaCalendar a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and promote that content on the Service and in related marketing (including email and social) for as long as the listing is published or as needed to operate the platform.
You represent that you have the rights to submit the content (including images and logos) and that it does not infringe others’ rights or violate law.
5. Event liability, cancellations & tickets
AtlantaCalendar does not guarantee that any event will occur as described. We are not responsible for cancellations, postponements, venue changes, sold-out status, weather, safety conditions, age restrictions, or disputes between attendees and organizers.
Ticket purchases, refunds, and entry policies are solely between you and the ticket seller or venue. Links to third-party ticketing sites are provided for convenience; their terms apply.
6. Free listings, boosts & advertising
Publishing a basic listing may be free. Paid products (such as boosts, sponsorships, homepage ads, or newsletter placements) are optional and governed by the checkout terms, package descriptions, and these Terms. Fees are generally non-refundable once promotion has started, except where required by law or expressly offered by us.
We may refuse, edit, unpublish, or remove listings or ads that are misleading, illegal, spammy, unsafe, or inconsistent with our editorial standards.
7. Acceptable use
You agree not to:
- Post false, fraudulent, or impersonating content
- Upload malware or attempt to disrupt the Service
- Scrape the Service in a way that harms performance or violates these Terms
- Harass users or post hate, illegal, or sexually exploitative content involving minors
- Use the Service to send spam or unauthorized commercial messages
8. Intellectual property
The AtlantaCalendar name, branding, site design, and original editorial content are owned by us or our licensors. Third-party marks (venues, artists, sponsors) belong to their owners. See our DMCA Policy for copyright complaints.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that event data is complete or accurate.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLANTACALENDAR AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM.
11. Indemnity
You agree to defend and indemnify AtlantaCalendar and its operators against claims arising from your content, your events, your use of the Service, or your violation of these Terms or applicable law.
12. Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Courts in Fulton County or the Northern District of Georgia shall have exclusive jurisdiction, except where prohibited.
